FAQ

If the house is in Caldwell, does living near the courthouse mean probate is already finished?

No. Caldwell is the Canyon County seat, which makes clerk and recorder geography convenient. It does not close an estate or appoint a signer. Whether a court file is needed depends on how title sits, what the estate papers say, and other facts this website cannot see. Idaho’s Uniform Probate Code describes powers of an appointed personal representative; it does not declare that every county-seat house has already completed probate.

What do Idaho Code § 15-3-711 and § 15-3-715 actually authorize when the property is in Caldwell?

Until the appointment ends, § 15-3-711 says a personal representative has the same power over estate title that an absolute owner would have, held in trust for creditors and others interested in the estate, and that the power may be exercised without notice, hearing, or court order. Section 15-3-715 enumerates authorized transactions, including selling estate real property, except as the will or a formal order restricts them and subject to fiduciary duties. Living in the county seat does not make every Caldwell heir that fiduciary.

Can a Caldwell heir rely on a transfer-on-death deed instead of Canyon County recording in 2026?
